LIMITED PRODUCT WARRANTY

Effective Date: August 20, 2024

TrackEase Inc. acts solely as a reseller and does not provide any warranty for hardware. All warranty claims related to hardware must be addressed directly with the manufacturer or official distributor, who bear sole responsibility for such warranties.

This disclaimer applies to all warranty claims. TrackEase Inc. makes no explicit or implied guarantees regarding the performance, quality, or durability of the hardware. Any issues or defects should be resolved with the manufacturer or distributor.

WARRANTY DISCLAIMER

To the fullest extent permitted by law, TrackEase Inc., along with its affiliates, licensors, suppliers, and distributors:

1. Makes no warranties of any kind—express, implied, statutory, or otherwise—regarding the hardware.

2. Disclaims all warranties, including but not limited to:

   • Implied or express warranties of merchantability, fitness for a particular purpose, non-interference, and non-infringement.

   • Warranties arising from any course of dealing, usage, or trade practices.

   • Warranties that the hardware will operate error-free or without interruptions.

The hardware is provided on an "as-is" and "as-available" basis. Customers are solely responsible for any loss, liability, or damages resulting from the installation of the hardware, compatibility with vehicles, and internet connectivity.

IMPORTANT NOTICE

The services and hardware are intended to assist drivers but do not replace the responsibilities of a safe and conscientious driver. These tools cannot compensate for driver impairment due to distractions, fatigue, drugs, alcohol, or other factors. Drivers must remain fully attentive and proactive to avoid accidents. Relying solely on services and hardware warnings may result in serious injury or property damage.

LIMITATION OF LIABILITY

TrackEase Inc.’s total liability under this Limited Hardware Warranty or from the use or inability to use the hardware will not exceed the total fees paid by the customer for the hardware.

To the fullest extent allowed by law, TrackEase Inc. and its affiliates, licensors, suppliers, and distributors disclaim liability for:

1. Indirect, incidental, special, punitive, exemplary, or consequential damages.

2. Loss of use, data, business, or profits, whether direct or indirect.

3. Personal injury, bodily harm, or property damage, regardless of the legal theory or whether TrackEase Inc. was advised of such damages.

Even if a limited remedy fails its essential purpose, these limitations remain fundamental to the agreement between TrackEase Inc. and the customer.

COMPATIBILITY

Customers are solely responsible for determining whether the hardware and services are compatible with their vehicles. TrackEase Inc. is not liable for any costs, expenses, or damages arising from compatibility issues.
